Terms.

Last updated: 2026-06-12. The agreement between you and Third Brain when you use this website or the Third Brain app. Short, fair, and written so you can actually read it.

What these cover.

These Terms apply to bethirdbrain.com (this marketing site) and the Third Brain app at app.bethirdbrain.com, plus any downloads, handbooks, or tools we make available from either. Together we call all of that "the Service."

By using the Service, you agree to these Terms. If you don't agree, please don't use it. If you're using the Service on behalf of a company or organization, you're confirming you have the authority to bind that organization to these Terms.

Who can use Third Brain.

You must be at least 13 years old to use the Service. If you're under 18, you confirm a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

What Third Brain is.

Third Brain helps you thrive in the age of AI with clearer thinking, holistic growth, and honest dialogue. The marketing site explains the philosophy and tools. The app is where you actually do the work — writing, journaling, taking notes, and working through frameworks.

We change things often. We may add, remove, or modify features at any time. We'll do our best to warn you before anything you depend on disappears, but the Service is offered on an "as-is" basis (see the disclaimers below).

Your account.

The app uses passwordless magic-link sign-in — we email you a one-time link instead of asking you to remember a password. You're responsible for keeping your email account secure, because anyone who can read your email can sign in as you. If you think someone has gained access to your account, please email us at brian@bethirdbrain.com.

You can delete your account at any time by emailing us. Deletion removes your account and the content stored in it, except where we're legally required to retain certain records (for example, transaction records for paid purchases).

Your content.

The Service lets you create content — notes, writing, journals, posts, and similar work. You own your content. We don't claim any ownership of what you write inside Third Brain.

To run the Service, we need a narrow license to store, display, back up, and process your content so we can show it back to you. By using the Service, you grant Third Brain PBC a non-exclusive, worldwide, royalty-free license to do exactly that — and only that — for as long as you keep your account. This license ends when you delete the content or your account, except for copies in routine backups that age out naturally.

If you choose to share content publicly through a feature we provide (for example, publishing a post), you're granting the same narrow license to anyone you've shared it with, for as long as you keep it public.

Acceptable use.

Don't use the Service to:

  • Break the law, infringe someone else's intellectual property, or violate someone else's privacy.
  • Harass, threaten, or harm others, or post content that does.
  • Upload malware, attempt to gain unauthorized access to the Service, or interfere with its operation.
  • Scrape, crawl, or harvest content or accounts at scale.
  • Use the Service to train, fine-tune, or evaluate machine-learning models without our written permission.

We may suspend or terminate accounts that violate these rules.

Payments.

Some parts of the Service may require payment. We're currently building out our payment system, which will use Stripe to process subscriptions and one-time purchases. If and when you buy something:

  • The price, billing cadence, and what you get are shown at checkout. By completing the purchase, you authorize us to charge your payment method.
  • Subscriptions renew automatically until cancelled. You can cancel anytime from your account settings or by emailing us; cancellation takes effect at the end of the current billing period.
  • Refund requests are reviewed case-by-case and decided in good faith. Email us within 14 days of a charge to request one.
  • Taxes are your responsibility unless we collect them at checkout.

Our intellectual property.

Third Brain®, the logo, the mascots, the trademarks (including SparkUps® and GrowthPods®), and the original copy, illustrations, and design across the Service are owned by Third Brain PBC. You're welcome to read, quote briefly with credit, and link to anything we publish. You can't reproduce, republish, or build derivative products from our brand assets or copy without written permission.

Privacy.

How we handle personal data is covered in our Privacy Policy. Using the Service means you've also read and accepted that policy.

Termination.

You can stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, or shut down features when we have to. Where reasonably possible, we'll give you a heads-up and a way to export your content first.

Changes to these Terms.

We'll update these Terms when we add features, change the business, or have to respond to new legal requirements. When we make a material change, we'll update the "Last updated" date at the top of this page, and — if you have an account — we'll email you. Continued use of the Service after a change means you accept the new Terms. If you don't accept them, please stop using the Service.

Governing law.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute that can't be resolved by good-faith conversation will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
